Terms and Conditions of Use
Kaizon Digital Services (a Limited Company registered in the United Kingdom under number: 15168068).
Please read these Terms and Conditions carefully before using our services or entering into a contract with us. By accessing our website or using our services, you agree to comply with and be bound by these terms in full. If you disagree with any part, please refrain from using our website or services.
1. Definitions
Company: Kaizon Digital Services (registered in the UK).
Client: Any individual or entity contracting with the Company for its services.
Services: Includes software development, hosting, creative design, and other digital services provided by the Company.
2. Services Provided
Software Development:
Software is designed according to the Client’s written requirements.
The Client is responsible for providing detailed specifications before work begins.
Hosting Services:
The Company provides hosting with specified features (e.g., storage, bandwidth).
The Company is not liable for service disruptions caused by external factors (e.g., power outages, global network failures).
The Client must comply with fair usage policies and avoid server misuse.
Creative Design:
Final designs are delivered after Client approval of prototypes.
The Company reserves the right to display completed work in its portfolio unless otherwise agreed.
3. Contract Terms
The Client must submit all required documents and information within 7 days of signing the contract.
Service costs and delivery deadlines are confirmed upon contract signing.
The Company reserves the right to adjust costs or timelines if the Client requests significant changes after project commencement.
4. Payment
Payment methods (bank transfer, credit card, etc.) are agreed upon in the contract.
50% of the total fee must be paid upfront to initiate work; the balance is due upon project delivery.
Late payments exceeding 15 days from the delivery date incur a 5% late fee on the total invoice.
Cancellation:
The Client may cancel services by providing written notice.
If cancellation occurs after work begins, 30% of the paid amount is deducted as compensation for incurred efforts.
5. Intellectual Property
Full intellectual property rights transfer to the Client upon complete payment.
The Company retains the right to use internal tools and pre-built modules in other projects.
The Client assumes full legal responsibility for any content (text, images, logos) provided to the Company for service execution.
6. Warranties and Technical Support
Warranty Period:
The Company provides a 6-month warranty to fix software defects arising from implementation.
The warranty excludes errors caused by unauthorized Client or third-party modifications.
Technical Support:
New Clients: Receive 12 months of free technical support from the service start date.
Post First Year:
Web Systems/Sites: Support fees of $30 USD every 3 months, paid in advance.
Mobile Applications: Annual support fee of $85 USD, paid in advance.
Support is available via email or the Company’s communication platform during business hours (Monday–Friday, 9 AM – 5 PM GMT).
Support does not cover issues caused by Client negligence (e.g., lost passwords, outdated systems).
Urgent or out-of-hours support requests may incur additional charges.
7. Disclaimer
The Company is not liable for indirect Client losses (e.g., lost profits, reputational damage) resulting from service use.
While the Company implements standard security measures, absolute protection against cyberattacks for hosting services is not guaranteed.
8. Contract Termination
The Company may terminate the contract immediately if the Client breaches any terms.
Upon termination, the Client must settle all outstanding payments promptly.
9. Amendments
The Company reserves the right to modify these terms at any time. Active Clients will be notified via email or the website.
